June 6 to Mr. Neeraj Rathi, with a copy to you.
As mentioned in the last para of
that email, this is to advise you that we have initiated steps to carry-out the
necessary changes/modifications (to the Order Execution Software) on our own to
remove the bugs/defects from the OES so as to make it work properly as
intended.
Please be further advised that
this change/modification of the software shall be carried out at your cost/risk
and that you shall reimburse us the costs incurred by us in this effort. When
the change/ modification work gets over, we will send you the relevant invoice
for reimbursement, for the costs incurred by us.
Please be further advised that
this action on our part is being taken to make the OES work properly so as to
stop us from incurring further/future business losses. In no way does our
action compromise our claim for the business losses actually suffered by us so
far, as outlined in our emails/letters dated
