not arrange) interviews of any one or more no. of candidates with the
client on different dates/times/venues of client's choice.
- Repating of "OUTSTANDINGS" must be
for all types of Invoices (Minm Search Fee & Advance/Progress
Payments/Final Payment & Out-of-Pocket Expenses).
- Proposal History

Interview, Time of Interview, Interview Venue. The logic is simple. Even if
we have shortlisted & recommended (say) 5 candidates to the client, there
is no way, we can insist/force the client to, Interview all of them (at all!)
OR Even give us an "Interview schedule" (date/time/venue) for all
of them right at the outset, even if he agrees/accepts that he will, in due
course, interview all of them There is no way, we can tell a customer, "Either
you give me interview date/time/venue for All or for NONE!" |

in the edit mode of Interview Schedule/interview reschedule, but after adding
new candidates in module-1 & subsequently in OES candidate
listing/transaction, system allows the user to save the record in this
screen. However in the EDIT mode of "Interview Schedule
screen", once we click the button "Get More" the
candidates (previously added & newly added) are reflected in the screen.
Once the user schedules the interview for newly added candidate, & the
moment tries to save it system gives the error mentioned below, "P01-2147467259

in this field so that one can enter the details about the rate contract.
AppliTech will explore the possibility to increase the field length but
AppliTech requested to use the system for 1 month and then decide on
the field length. |

background of this matter, I am sure, you would not have sent the
above-mentioned letter. In fact, I have a feeling that you would have persuaded
your technical / marketing team to first complete the debugging of the Order
Execution Software developed by you.
To make you fully aware of the
background, I enclose for your careful study, copies of our following letters/
notices, sent to your executives:

incurred further business-loss of yet another sum of Rs. 50 Lakhs

SUB: - OUTSTANDING PAYMENTS OF
RS 4.95 LACS.
Apropos above, we refer to our
purchase order executed by 3P Consultants Pvt Ltd (3P) dated August,
24,2000, revised purchase order dated September 14, 2000 &
purchase order amendment dated Oct, 5, 2001 with Applitech Solution
Ltd ("the company") for the design development installation and
commission of "order execution system software". Pursuant to
the purchase order Applitech has executed the said software. However 3P has not
paid the entire consideration amount for the said software 3P is currently
liable to make payment of Rs 4.95 Lacs (Dues) to the company. Till this
date 3P has neglected & failed to pay to the company the dues inspite of
repeated reminders from the company.
There is still time, however, to
avoid suit if you contact us within the next seven (7) days for release
of our payment or submit us an acceptable proposal for payment of the
outstanding amount.
This will be your final
opportunity to resolve matters without the expense of court proceedings,
failing to resolve, our advocates on our behalf will initiate legal action at
your cost and consequences.

The board of the
Mumbai-headquartered Saraswat Co-operative Bank Ltd discontinued the services
of managing director D R Shirodkar on Saturday and appointed S K
Banerjee, general manager (legal), as acting managing director.1234
Shirodkar said the board
expressed no confidence in his system of working. He joined Saraswat Bank in
1970 as a sub-accou5ntant and rose to the position of managing
director in 1998. Banerjee was also not available for comments. Insiders said
that Shirod6kar was sacked as he refused to yield to extraneous
influences. He was a victim of a political game, they added.78
Saraswat Bank was in the new9s
recently as it sent a legal notice to i-flex Solutions claiming damages
of Rs 250 cr10ore on account of opportunity loss, loss of
business and other costs on account of problems in implementing on time 'Flex
Cube', a complete core banking solution package which would enable the bank
to operate through a11 centralised network and automa12te
ing its retail, treasury and whole-sale banking operations with the total
contract value working out to a sum of Rs 3.5 crore.13
However, instead of suing for
damages immediately, the bank has chosen to appoint an arbitrator and then file
a writ14 petition seeking certain injunctions.

With reference to the newspaper
advertisement of Prospectus (advertisement) of I-flex solutions ltd. (I-flex)
concerning their public issue through book building method, published in the
Business Standard dated June 21, 2002, Saraswat Bank states as follows: -
The Bank reiterates and stands by
the Public Notice issued by the Bank as well as the various statements made by
the Bank in the newspaper articles which appeared in several publications.
- The advertisement of I-flex contains various false
and misleading statements concerning licence agreement with the Bank
and the Bank's claims.
- The statement made by I-flex that they had
delivered 19 modules (except 3) is misleading and incorrect. The
Bank states that I-flex has not delivered or implemented the software
packages as per the agreement. The 16 modules delivered are incomplete
and do not meet the requirements as per the agreement.
- The statement made by I-flex that the Bank has
signed UAT is misleading and incorrect. The Bank has signed UAT
conditionally subject to I-flex delivering many mission critical and
statute compliant requirements in their software. This was acknowledged by
I-flex and the said requirements were not delivered.
- Payments against all invoices raised by I-flex to
date have not been made as stated. This was also informed to their
auditors. The reasons stated by I-flex for non-payment are incorrect.
Payments in respect of certain milestones have not been made, as
all functional aspects of the software modules have not been complied with
fully by I-flex.
- As a result the Bank has sent a Legal Notice to
I-flex terminating the agreement and claiming losses. However, I-flex have
not stated the contents of the Notice in entirety in the advertisement. In
addition to claims for non performance, the Notice also contained the
following claims: -
a) I-flex to desist from
marketing the versions of FLEXCUBE software which incorporate the business
knowledge and ideas and proprietary information of the Bank.
b) I-flex violated the terms of
agreement by employing the Bank personnel.
This Notice has been issued in
the interest of the Public at large.
